TERMS & CONDITIONS
By registering to bid, placing a bid, or attending any auction conducted by Rambler Auction Co. (“Auction Company”), each bidder agrees to the following Terms & Conditions.
1. Bidder Registration
All bidders must register prior to bidding.
A valid government-issued photo ID is required.
Rambler Auction Co. reserves the right to refuse or revoke bidding privileges at its sole discretion.
2. Buyer’s Premium
A buyer’s premium, if applicable, will be clearly stated in the auction advertising and added to the final bid price to determine the total purchase price.
3. Payment
Payment is due in full on the day of the auction unless otherwise announced.
Accepted payment methods may include:
Cash
Certified Funds
Wire Transfer
Approved Business Check
Major Credit/Debit Cards (processing fee may apply)
No property will be released until payment has been received in full.
4. Sales Tax
Applicable state and local sales tax will be collected unless the buyer provides a valid resale or tax exemption certificate prior to payment.
5. As-Is, Where-Is
All property is sold AS IS, WHERE IS, WITH ALL FAULTS, without warranty or guarantee of any kind, either expressed or implied.
Rambler Auction Co. and the Seller make no warranties regarding:
Condition
Age
Authenticity
Merchantability
Fitness for a particular purpose
Description
Mileage or hours
Mechanical condition
Buyers are encouraged to inspect all items before bidding.
6. Inspection
Inspection times will be announced prior to each auction. It is the bidder’s responsibility to determine the condition and suitability of each item before placing a bid.
7. Auctioneer Authority
The Auctioneer has sole discretion to:
Accept or reject any bid
Determine bidding increments
Resolve disputes between bidders
Re-open bidding if necessary
Withdraw any item prior to the fall of the hammer
Combine or divide lots
Correct clerical or catalog errors
The Auctioneer’s decision is final.
8. Reserve Auctions
Unless specifically advertised as an Absolute Auction, all auctions are conducted with reserve. Sellers reserve the right to accept or reject the final bid.
9. Online Bidding
Online bidding is offered as a convenience.
Rambler Auction Co. is not responsible for:
Internet outages
Platform failures
Delayed bids
Software errors
Power interruptions
Technical malfunctions
The Auction Company reserves the right to continue, suspend, or restart bidding if technical issues occur.
10. Removal
All purchases must be removed within the announced removal period.
Any property left beyond the stated removal deadline may:
Be subject to storage fees
Be considered abandoned
Be resold without refund
Buyers are responsible for all loading, transportation, labor, and insurance.
11. Risk of Loss
Responsibility for purchased property transfers to the buyer immediately upon being declared the successful bidder.
12. Default
Failure to pay or remove purchases constitutes default.
Rambler Auction Co. may:
Cancel the sale
Retain deposits
Resell the property
Recover any deficiency
Recover attorney fees and collection costs where permitted by law
Permanently revoke bidding privileges
13. Descriptions
Descriptions, photographs, advertisements, catalogs, and verbal statements are believed to be accurate but are not guaranteed.
Announcements made by the Auctioneer on auction day take precedence over all printed or online material.
14. Equipment
Hour meters, odometers, model years, VINs, serial numbers, and specifications are believed to be accurate but are not guaranteed.
15. Indemnification
Buyers agree to indemnify and hold harmless Rambler Auction Co., its owners, employees, agents, auctioneers, and sellers from any claims, damages, injuries, or losses arising from participation in the auction or ownership, loading, transportation, or use of purchased property.
16. Limitation of Liability
The maximum liability of Rambler Auction Co. shall never exceed the purchase price actually paid for the item in dispute.
17. Governing Law
These Terms & Conditions shall be governed by the laws of the State of Tennessee.
Any legal action shall be brought in a court of competent jurisdiction located in the county where the auction was conducted unless otherwise required by law.
18. Acceptance
Registering to bid or placing any bid constitutes acceptance of these Terms & Conditions.
